Welcome to Airestate, a managed website platform built for real estate professionals who want a high-quality online presence without managing technical systems themselves. These Terms of Service (“Terms”) form a binding agreement between you and MYHELLO LLC, governing your use of Airestate’s managed website services, platform features, and any support delivered through our Success Team. By requesting updates, reviewing drafts, interacting with our team, or using any part of the Airestate service, you accept these Terms and acknowledge that they apply to all work we perform on your behalf. If you have signed a separate written agreement or Order Form with Airestate, that document will take precedence in the event of a conflict. These Terms are governed by the laws of the State of Delaware, USA. For questions, contact team@airestate.io.
Airestate operates exclusively as a managed service. Clients do not access internal tools, backend systems, or administrative interfaces. Instead, Airestate’s Success Team manages the website for you, including setup, design, updates, integrations, content adjustments, and ongoing maintenance. This ensures consistent quality, reliable performance, and controlled technical operations. Because the platform is managed centrally, Airestate retains full discretion over how features are implemented, how the system evolves, and what technical changes are required to maintain performance, stability, and compliance. Features may be updated, replaced, improved, or discontinued as necessary to keep the platform functioning securely and effectively.
“Airestate,” “we,” or “us” refers to MYHELLO LLC and its affiliates, contractors, and support partners acting under its direction. “Client” or “you” refers to the individual or business using Airestate’s services. “End Users” are the visitors, buyers, sellers, or individuals who interact with your website. “Platform” refers to the full set of technology, systems, integrations, infrastructure, workflows, and proprietary tools used to deliver the service. “Client Content” means all material you provide, including text, images, branding, property information, and any other assets used on the website. “Third-Party Services” refers to external tools or systems integrated into your site, including MLS and IDX feeds, hosting environments, analytics platforms, email systems, map services, and APIs.
You must be at least eighteen years old and legally able to enter a binding contract to use Airestate. By engaging Airestate or requesting work from the Success Team, you confirm that you meet these requirements and accept these Terms. Because Airestate is a managed service, clients do not receive direct access to the platform’s backend or internal systems. All updates, changes, and configurations are carried out by Airestate on your behalf.
Airestate provides a managed website service that includes setup, design, technical configuration, integrations, maintenance, and ongoing improvements. The exact features and level of service depend on the plan or package you selected. Airestate may adjust or refine the platform at any time to maintain stability, security, compatibility, or performance. While Airestate aims to provide a reliable experience, no technology platform can guarantee uninterrupted or error-free operation, and certain limitations may be necessary for the system to function correctly.
You retain all rights to the material you provide for your website. By supplying content to Airestate, you grant us a non-exclusive license to use, reproduce, modify, and display that content solely for the purpose of delivering and maintaining your website. You are responsible for ensuring that all content you submit complies with applicable laws, does not infringe the rights of others, and is appropriate for public display.
Clients do not have administrative access to the Airestate platform. All technical, design, and content adjustments must be requested through Airestate’s Success Team. Any attempt to bypass access restrictions or interfere with platform systems is prohibited and may result in immediate termination of your service.
You agree to use Airestate’s services in accordance with all applicable laws and regulations, including those governing fair housing, advertising, and data privacy. You may not use the platform to transmit unlawful, offensive, harmful, misleading, or infringing material. You may not attempt to disrupt or overload the platform, reverse-engineer its systems, or misuse MLS or IDX data in ways that violate their rules. Airestate may suspend or terminate services if your actions create legal, security, or operational risk.
You are responsible for providing accurate, lawful, and complete information necessary for Airestate to build and maintain your website. This includes property data, images, branding, business details, and any other materials required for updates or content changes. You must ensure that all content you provide complies with fair housing laws, advertising regulations, MLS and IDX rules, copyright requirements, and any other applicable standards. You agree to respond to Airestate’s requests for approvals, clarifications, or additional materials in a timely manner. You are responsible for maintaining copies or backups of your own materials if you require long-term archival outside of the platform. Content errors, omissions, or delays caused by incorrect or incomplete information provided by you are not the responsibility of Airestate.
Airestate will manage and maintain your website in accordance with the services defined in your active plan. This includes design setup, technical configuration, performance monitoring, content updates upon request, and the integration of approved third-party services such as MLS or IDX feeds. Airestate will make reasonable efforts to ensure the platform remains stable, secure, and functional. While Airestate aims to provide responsive support, the timing and method of updates or issue resolution may vary depending on the nature of the request and the technical requirements involved. Airestate may enhance, adjust, or improve features and infrastructure when necessary to maintain the overall quality and reliability of the service.
Airestate may integrate your website with third-party services such as MLS providers, IDX vendors, API systems, map services, analytics platforms, email tools, or hosting providers. These third-party systems operate independently and are governed by their own policies, rules, and technical limitations. Airestate is not responsible for changes, delays, outages, inaccuracies, or disruptions caused by third-party services, nor for any updates these external systems may impose. You are responsible for ensuring you have the rights, credentials, and permissions required to use any MLS or IDX data. Airestate cannot guarantee the accuracy, timeliness, or completeness of MLS or IDX information.
You agree to indemnify and hold harmless Airestate, its owners, employees, and service partners from any claims, liabilities, damages, losses, or expenses arising from your content, your use of the service, your violation of laws or MLS/IDX rules, or any dispute initiated by individuals interacting with your website. This includes issues stemming from inaccurate property data, improper use of images or text, copyright violations, misrepresentation, or non-compliance with applicable regulations. This indemnification survives the termination of your agreement with Airestate.
Any attempt to gain unauthorized access to the Airestate platform, servers, codebase, infrastructure, or administrative systems is strictly prohibited. Such actions constitute a breach of these Terms and may result in immediate suspension or termination of services, as well as potential legal action. You are responsible for ensuring that anyone acting on your behalf does not attempt to circumvent access restrictions or interfere with the operation of the platform.
Airestate services are offered on a subscription basis. Your subscription begins when you sign up and provide a valid payment method. You authorize Airestate to charge this payment method for all recurring subscription fees, setup fees, add-on fees, overages, and any other charges associated with your account. All fees must be paid in full and on time for services to remain active. Fees are stated during the signup process and may vary depending on your selected plan. Unless otherwise specified in writing, all payments are processed in advance and billed automatically through Stripe. You are responsible for keeping your billing information accurate and up to date.
A non-refundable setup fee is required to initiate your project. This fee covers initial configuration, onboarding, design preparation, and the work necessary to launch your website on the Airestate platform. The setup fee is charged once and is separate from ongoing subscription fees.
All listed prices exclude applicable taxes. You are responsible for any taxes, duties, or government charges associated with your use of Airestate’s services, except for taxes based on Airestate’s income. If required by law, Airestate may charge and collect applicable taxes from you.
Subscriptions renew automatically at the end of each billing cycle unless canceled in accordance with these Terms. By maintaining an active account, you acknowledge and authorize recurring automatic charges. You may switch between monthly and annual billing cycles when available, and pricing may differ depending on your selected cycle.
If a payment is declined or cannot be processed, Airestate may attempt to re-charge your payment method. If payment remains outstanding, Airestate may suspend or terminate your services until all overdue amounts are paid. You remain responsible for all unpaid fees. Airestate may apply interest or late charges where permitted by law.
All payments to Airestate, including setup fees, subscription fees, and fees for add-ons or custom work, are non-refundable. Airestate does not offer refunds for partial billing periods, unused time, unused services, or delays caused by the Client. This policy applies regardless of cancellation date or usage level.
You may cancel your subscription at any time by notifying Airestate. Cancellation takes effect at the end of your current billing cycle. Your website will remain active until that date, after which it will be taken offline unless otherwise agreed in writing. Canceling your subscription does not entitle you to a refund of any fees paid.
If you upgrade your plan, the difference in fees may be charged immediately and prorated for the remaining period of your current billing cycle. Downgrades take effect at the start of the next billing cycle. Additional services such as custom design, expanded MLS integrations, bandwidth extensions, or listing sync increases may result in additional charges.
Airestate may adjust pricing from time to time to reflect changes in operating costs, infrastructure expenses, or third-party service rates. Airestate will provide at least thirty days’ notice before new pricing takes effect. Continued use of the services after the effective date of new pricing constitutes acceptance of the revised fees.
Airestate aims to maintain a stable and reliable platform with consistent performance and minimal disruption. While we strive for high availability, no digital service can guarantee uninterrupted access. Scheduled maintenance, infrastructure updates, improvements, or third-party service outages may affect availability from time to time. Airestate will make reasonable efforts to perform planned maintenance during low-traffic periods and to minimize any disruption. Airestate is not responsible for downtime caused by factors outside of its direct control, including issues originating from hosting providers, MLS or IDX systems, domain registrars, global network conditions, or client-side connectivity problems.
Airestate continuously updates its systems to improve performance, security, and user experience. These updates may include adjustments to infrastructure, design systems, integrations, or the underlying technology stack. Because Airestate operates as a fully managed platform, updates may be deployed without prior notice when necessary to maintain system integrity. Airestate retains full discretion over the timing, nature, and scope of platform improvements.
From time to time, Airestate may provide access to beta or experimental features, such as early versions of new design systems, interface components, or tools. These features are offered on an “as available” basis and may be modified or discontinued at any time. Beta features may contain bugs or limitations and are not subject to the same performance expectations as the core platform. By using beta features, you acknowledge that they are provided without warranties of any kind.
Airestate provides support for questions, updates, and issues related to your website. Support is handled by the Airestate Success Team and may be delivered through email, scheduled calls, or other communication methods. Response times may vary depending on the complexity and urgency of the request. While Airestate makes reasonable efforts to address requests promptly, no specific response-time guarantee is offered unless expressly stated in a separate agreement.
Airestate relies on external services, including hosting providers, MLS and IDX integrations, mapping tools, and other third-party APIs to deliver certain functionalities. These external systems operate independently and may experience interruptions or technical issues beyond Airestate’s control. Airestate is not liable for delays, inaccuracies, or disruptions caused by third-party services. If a third-party provider changes its policies, pricing, access rules, or API functionality, Airestate may need to modify, suspend, or remove related features as necessary to remain compliant.
Airestate implements industry-standard security measures designed to protect your website and the data processed by the platform. These measures include encryption, permission controls, secure hosting infrastructure, and continuous monitoring. However, no system can guarantee complete protection against vulnerabilities, cyberattacks, or breaches. You acknowledge that security risks exist in all online systems and agree that Airestate is not liable for damages resulting from unauthorized access or data loss beyond its reasonable control. You are responsible for reporting any suspected security issues promptly to Airestate so they can be addressed.
Airestate is not liable for any failure or delay in service caused by events outside its reasonable control. These may include, without limitation, natural disasters, power failures, labor disputes, cyberattacks, widespread internet outages, outages from hosting providers, governmental actions, or other events that make performance impracticable. Airestate will make reasonable efforts to resume normal service as soon as conditions allow.
If Airestate experiences significant operational changes, such as major restructuring or a shift in business focus, we will maintain existing client websites for a reasonable continuity period to avoid sudden disruption. In such cases, Airestate may adjust the level of service, pricing, or availability of new features, but will continue to provide essential hosting, maintenance, and security measures until clients have reasonable time to transition if desired. Airestate reserves the right to operate the platform in maintenance mode during such periods, with limited updates or new feature development.
You retain full ownership of all content you provide to Airestate, including text, images, branding, property information, media files, and any other materials used on your website. By submitting this content, you grant Airestate a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, and display the content solely for the purpose of delivering, maintaining, and improving your website and associated services. You are fully responsible for ensuring that all Client Content complies with applicable laws, does not violate third-party rights, and is authorized for public display. Airestate has no obligation to verify the accuracy or legality of Client Content and is not liable for any consequences arising from its publication.
All technology, infrastructure, software, tools, interfaces, templates, workflows, design systems, code, features, algorithms, architecture, documentation, branding, and any other intellectual property that forms part of the Airestate platform remain the exclusive property of Airestate. Using the Airestate service does not grant you ownership, rights, or access to the platform’s underlying systems or intellectual property. You may not copy, modify, reverse-engineer, extract, or create derivative works from any part of the Airestate platform. Any attempt to do so constitutes a breach of these Terms and may result in legal action and immediate termination of your service.
Unless you specifically request otherwise in writing, Airestate may use your business name, trade name, logo, and website as examples of work produced through the platform. This may include display on Airestate’s website, marketing materials, sales presentations, or product demonstrations. Airestate will not disclose confidential or proprietary information about your business beyond publicly visible website content. You may revoke permission for Airestate to use your marks at any time by sending written notice to support@airestate.io.
You may not use Airestate’s trademarks, logos, branding elements, or design assets without prior written permission. Any approved use must comply with Airestate’s branding guidelines and cannot misrepresent your relationship with Airestate.
If you provide materials obtained from third parties—such as MLS photos, licensed images, copywritten descriptions, or vendor-provided assets—it is your responsibility to ensure that all necessary rights, licenses, and authorizations have been secured. Airestate is not responsible for verifying third-party licensing and is not liable for copyright claims, takedown requests, or legal disputes arising from unauthorized use of such materials. If Airestate receives a complaint or notice regarding third-party content used on your website, Airestate may remove or disable the content at its discretion to comply with legal or regulatory requirements.
If you provide feedback, recommendations, feature ideas, or any form of suggestion intended to improve the Airestate platform or services, you acknowledge that Airestate may use such input freely without obligation to you. This includes the right to implement ideas, develop new features, modify existing functionalities, or incorporate suggestions into the platform without compensation or recognition. All improvements made to the platform—regardless of their origin—remain the exclusive property of Airestate.
Airestate provides the platform and all associated services on an “as-is” and “as-available” basis. While Airestate strives to maintain a high-quality, stable, and reliable service, we do not guarantee that the website, integrations, or platform features will operate without interruption, error, delay, or defect. You acknowledge that all digital systems carry inherent risks, including technical limitations, service interruptions, and potential inconsistencies in third-party data sources. Airestate does not warrant that any specific results, business outcomes, traffic levels, lead volume, or improvements in performance will occur as a result of using the platform.
To the fullest extent permitted by applicable law, Airestate’s total liability to you for any claim arising out of or related to the use of the service is strictly limited to the total amount you have paid to Airestate in the twelve months preceding the claim. Airestate is not liable for any indirect, incidental, consequential, punitive, or special damages, including but not limited to lost profits, lost leads, lost business opportunities, loss of data, loss of reputation, downtime, or costs associated with replacing services. This limitation applies regardless of the form of the claim, whether based on contract, tort, negligence, strict liability, or any other legal theory, even if Airestate has been advised of the possibility of such damages.
Airestate integrates with MLS providers, IDX vendors, hosting environments, map services, analytics tools, authentication systems, and other external services. These third-party systems function independently and may introduce delays, inaccuracies, or interruptions outside Airestate’s control. Airestate is not responsible for errors, outages, restricted access, policy changes, data discrepancies, API failures, service deprecations, or pricing adjustments imposed by third-party systems. If a third-party provider changes or discontinues a feature, Airestate may need to modify or remove related functionality without liability.
You are solely responsible for ensuring that all content displayed on your website—including property data, images, descriptions, disclaimers, legal notices, pricing information, and branding—complies with applicable laws and regulations, including fair housing requirements, advertising standards, privacy laws, MLS rules, and IDX guidelines. Airestate does not verify content for legal accuracy or compliance and is not liable for issues arising from incorrect, misleading, or unlawful content. You acknowledge that your website may pull data from MLS and IDX sources and that Airestate cannot guarantee the accuracy, currency, or completeness of information originating from those systems.
Airestate uses industry-standard measures to protect your website and data. However, no system can guarantee absolute security or prevention of data loss. You acknowledge that data may be lost, corrupted, or inaccessible due to system failures, third-party outages, cyberattacks, software errors, or client-side actions. Airestate is not liable for any loss of data or content stored on the platform. You are responsible for maintaining personal backups of any essential information if you require off-platform copies.
You are responsible for complying with all legal obligations relevant to your business and website content, including consumer protection laws, real estate regulations, licensing requirements, advertising restrictions, privacy rules, and local, state, and federal obligations. Airestate does not act as your legal advisor and does not provide legal or regulatory guidance. Any compliance issues resulting from your content, business operations, or use of the platform remain your sole responsibility.
You agree to defend, indemnify, and hold harmless Airestate, its owners, employees, partners, and affiliates from and against any claims, actions, damages, liabilities, losses, costs, or expenses arising from your use of the platform, your content, your violation of these Terms, your non-compliance with applicable laws, or any disputes initiated by third parties (including clients, End Users, or MLS/IDX providers). This obligation continues even after your subscription or agreement with Airestate ends.
If service interruptions occur, Airestate will make reasonable efforts to restore functionality as quickly as possible. Airestate may issue service credits for extended downtime at its discretion, but these credits are not guaranteed, and they are your sole and exclusive remedy for issues related to availability or performance. Airestate is not responsible for any damages resulting from downtime, maintenance windows, technical issues, or delays.
If this meets your expectations, say continue, and I will deliver Section 8.
You may terminate your Airestate subscription at any time by providing written notice to Airestate. Termination becomes effective at the end of your current billing cycle, and your website will remain online until that date. Once the billing cycle ends, your website will be taken offline unless otherwise agreed in writing. Termination does not entitle you to refunds for any portion of your setup fee, subscription payments, unused time, or unused services. You are responsible for downloading or saving any content or data you wish to keep prior to the termination date.
Airestate may suspend or terminate your access to the service if you fail to pay required fees, violate these Terms, misuse the platform, breach MLS or IDX rules, publish unlawful or harmful content, attempt unauthorized access to the platform, create security risks, or engage in conduct that disrupts service for other clients. Airestate may also suspend service if continued operation becomes impractical due to regulatory changes, external requirements, or necessary technical decisions. In cases of non-payment, service may be suspended immediately until outstanding balances are resolved. Airestate is not liable for any losses you incur as a result of suspension or termination caused by your actions.
If Airestate undergoes structural changes such as reorganization, sale, discontinuation of certain features, or transition to a maintenance-only mode, Airestate may adjust the level of service provided. In such circumstances, Airestate will make reasonable efforts to maintain existing client websites during a transition period. Essential hosting and security measures will continue until clients have had a reasonable opportunity to migrate, unless circumstances outside Airestate’s control prevent this. Airestate may adjust pricing, feature availability, or support levels accordingly.
Upon termination of your account for any reason, your access to the Airestate service ceases immediately. All website hosting, updates, integrations, and support services stop once the termination becomes effective. Airestate will retain your website data for thirty days following termination, after which all data may be permanently deleted from our systems without further notice. You are responsible for ensuring that any data you wish to keep is exported or captured within this thirty-day period. After deletion, Airestate has no obligation to recover or restore any information.
Termination of the service, whether initiated by you or by Airestate, does not release you from your obligation to pay any outstanding fees, service charges, custom work fees, or amounts accrued before the termination date. Airestate may take reasonable steps to collect all unpaid balances, and refusal to pay may lead to further collection action.
Certain sections of these Terms continue to apply even after your subscription ends. These include provisions relating to content ownership, intellectual property, confidentiality, limitation of liability, indemnification, payment obligations, dispute resolution, and any other sections that by their nature are intended to survive termination.
These Terms and all matters arising out of or related to your use of the Airestate platform are governed by the laws of the State of Delaware, without regard to conflict-of-law principles that would apply the laws of another jurisdiction. You are solely responsible for ensuring that your use of the service complies with all applicable local, state, federal, and international laws relevant to your business and website content.
Before taking any formal legal action, both parties agree to attempt to resolve disputes in good faith. If a disagreement arises, the party initiating the dispute must send written notice describing the issue in reasonable detail. Both parties will then attempt to resolve the matter informally within thirty days of receiving the notice. Engaging in this process is a prerequisite to initiating arbitration or any other formal dispute proceedings unless the matter involves urgent equitable relief.
If a dispute cannot be resolved informally, it must be submitted to binding arbitration. Arbitration will be conducted in Delaware, USA, under the rules of the American Arbitration Association or another mutually agreed-upon arbitration body. The arbitration will be handled by a single arbitrator with experience in commercial and technology agreements. Each party will bear its own legal fees and costs, and the parties will share the arbitrator’s fees unless the arbitrator determines otherwise. The decision of the arbitrator is final and enforceable in any court with jurisdiction.
Certain claims are exempt from mandatory arbitration. Either party may seek relief in a court of competent jurisdiction for disputes involving the misuse, violation, or unauthorized use of intellectual property rights, including copyrights, trademarks, trade secrets, or proprietary technology. Disputes that fall within the jurisdiction of small claims court may also be brought directly in such court in Delaware.
To the maximum extent permitted by law, both parties agree that all disputes must be resolved on an individual basis. Neither party may participate in or bring claims as a plaintiff or class member in any class, consolidated, collective, public, or representative action. If this waiver is found to be unenforceable with respect to any particular claim, then the entire arbitration provision shall be deemed void for that claim, and such claim may proceed in court.
For any dispute not subject to arbitration or exempted under these Terms, both parties agree to the exclusive jurisdiction of the state and federal courts located in Delaware. You consent to personal jurisdiction in these courts and waive any objections based on inconvenient forum or lack of jurisdiction.
Airestate collects information necessary to operate and improve the platform. This may include account details such as your name, email address, phone number, company information, billing information, and domain-related data. We may also collect technical information such as IP addresses, device identifiers, browser data, usage logs, and interactions with the website or platform. When you provide property data, branding assets, images, or content through the Success Team, this material is treated as Client Content and processed solely for the purpose of building and maintaining your website.
Airestate uses collected information to deliver the managed service, configure and maintain your website, manage integrations, provide support, and operate the underlying platform. Information may also be used to monitor system performance, ensure security, improve features, develop new capabilities, and analyze aggregated usage patterns. Airestate does not sell personal information and does not use Client Content for marketing purposes without your permission.
Airestate may share information with service providers who assist in delivering the platform, such as hosting providers, email systems, analytics tools, payment processors, and infrastructure partners. These third parties are permitted to process information only to support the services they provide to Airestate. Information may also be shared when required by law, in response to legal process, or when necessary to protect Airestate’s rights, security, or operations. In the event of a merger, acquisition, or business transition, collected information may be transferred as part of the transaction.
Airestate implements industry-standard measures to protect both your account information and the content displayed on your website. This includes encryption, secure data transmission, controlled server environments, and proactive monitoring. However, no online system can guarantee absolute protection from unauthorized access, cyberattacks, or technical failures. You acknowledge that security risks exist in all digital systems and agree that Airestate is not liable for damages arising from security incidents beyond our reasonable control.
Certain U.S. states provide residents with rights regarding their personal information, including the right to request access to collected data, the right to request deletion or correction, and the right to opt out of certain types of data sharing. Requests may be submitted to privacy@airestate.io, and Airestate will respond in accordance with applicable laws. Airestate does not discriminate against users who exercise these rights. Clients remain responsible for ensuring that their own business practices comply with applicable privacy laws, including informing their website visitors about data collection where required.
Airestate retains data as long as necessary to provide services, comply with legal obligations, resolve disputes, or enforce agreements. Upon cancellation or termination, website data is retained for thirty days, after which it may be permanently deleted. Airestate has no obligation to store or preserve data beyond this period unless otherwise required by law.
If your website collects information from End Users—such as contact form submissions, inquiries, or user-generated data—you are responsible for complying with all applicable privacy and data protection laws governing the handling of such information. Airestate does not oversee how you use End User data and is not responsible for your privacy practices or obligations regarding that information.
For the purposes of these Terms, “Confidential Information” refers to any non-public information disclosed by one party to the other that is identified as confidential or that a reasonable person would understand to be confidential based on the nature of the information or the circumstances of disclosure. This may include business details, internal processes, platform architecture, technical specifications, financial information, user data, strategy documents, design drafts, property information not yet intended for publication, or any other proprietary material. Confidential Information does not include information that becomes publicly available through no fault of the receiving party, information independently developed without reference to the confidential material, or information lawfully obtained from a third party without restriction.
Each party agrees to protect the other party’s Confidential Information using at least the same level of care it uses to protect its own confidential material, and in no event less than a reasonable standard of care. Confidential Information may be used only for purposes directly related to the performance or receipt of services under these Terms. Neither party may disclose the other party’s Confidential Information to any third party except to employees, contractors, or advisors who have a legitimate need to know and who are bound by confidentiality obligations no less restrictive than those described here.
A party may disclose Confidential Information if required to do so by law, regulation, subpoena, or court order, provided that the disclosing party gives prompt notice to the other party (unless legally prohibited) so that the other party may seek protective measures. Airestate may also disclose limited Confidential Information to service providers assisting with hosting, infrastructure, or support, but only to the extent necessary to perform their duties and in accordance with appropriate confidentiality obligations.
Upon written request or upon termination of your subscription, each party will make reasonable efforts to return or securely delete the other party’s Confidential Information, unless retention is required by law or necessary for legitimate business purposes related to the performance of these Terms. Airestate may also retain archived copies of data for obligations such as system backups or compliance requirements, provided such data is not used for any purpose unrelated to service delivery.
The confidentiality obligations set forth in this section continue for three years after your subscription or agreement with Airestate ends. Certain information, such as trade secrets or proprietary technology, may remain protected for a longer period under applicable law.
Airestate may provide access to artificial intelligence–powered features within the platform or through the Airestate Success Team. These tools are designed to support tasks such as content generation, property descriptions, messaging suggestions, lead interactions, analytics, workflow automation, or other AI-assisted capabilities. AI features are optional components of the service and may change, expand, or be removed as the underlying technology evolves.
AI-generated outputs may contain inaccuracies, inconsistencies, or unintended errors. They should not be relied upon as a sole source of truth for legal, financial, or compliance-related decisions. You acknowledge that AI systems make predictions based on patterns and that results may vary depending on context, input quality, third-party data sources, and model limitations. Airestate does not guarantee the correctness, completeness, or reliability of AI-generated content and is not liable for any decisions, actions, or outcomes that rely on AI outputs.
Airestate does not use your data to train third-party AI models. Any Client Content or internal platform data used within AI features is processed solely to generate outputs for your individual use and is not used to improve or retrain external AI systems. If Airestate offers an AI feature that requires your data to be stored or processed differently than described, Airestate will inform you in advance or request consent where required.
Any content produced by AI features is treated as Client Content once delivered to you. You are responsible for reviewing, editing, verifying, and approving AI-generated outputs before they are published or used in any business context. This includes ensuring compliance with real estate advertising standards, fair housing laws, branding requirements, and factual accuracy. Airestate is not responsible for content issues that arise from your reliance on AI-generated text, images, or other outputs.
AI features may depend on third-party providers, APIs, or models that Airestate does not control. These providers may adjust their systems, usage limits, pricing, or availability at any time. As a result, Airestate may need to modify, limit, or discontinue certain AI capabilities without prior notice. Airestate is not liable for service limitations, increased costs, or functional changes resulting from adjustments made by those third-party providers.
These Terms constitute the complete and exclusive agreement between you and Airestate regarding your use of the platform and services. They supersede all prior agreements, communications, or understandings, whether written or oral, relating to the subject matter. Any additional or conflicting terms proposed by you are expressly rejected unless accepted in writing by Airestate.
You may not assign, transfer, or delegate any of your rights or obligations under these Terms without Airestate’s prior written consent. Airestate may assign its rights or obligations at any time, including in connection with a merger, acquisition, corporate restructuring, or sale of assets. Any attempted assignment in violation of this section is void.
If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court or arbitrator of competent jurisdiction, the remaining provisions will continue in full force and effect. The invalid portion will be modified only to the extent necessary to make it enforceable while preserving the original intent.
Airestate’s failure at any time to enforce any provision of these Terms does not constitute a waiver of that provision or of any other provision. Any waiver must be expressly stated in writing and signed by an authorized representative of Airestate. No waiver applies to future breaches unless explicitly stated.
Notices or communications required under these Terms must be sent in writing. Notices to Airestate must be submitted to support@airestate.io unless otherwise directed. Notices to you will be sent to the email address or billing address associated with your account. You agree that electronic communications satisfy any legal requirement for written notice.
Airestate is not liable for delays or failures to perform caused by circumstances beyond its reasonable control, including natural disasters, power outages, technology failures, cyberattacks, labor disputes, third-party provider issues, government actions, or other events that make performance impracticable. Airestate will resume performance as soon as it is reasonably able to do so.
Airestate may update these Terms to reflect changes in the platform, business operations, security requirements, or applicable laws. Updates will take effect thirty days after Airestate provides notice through email or a platform announcement. Your continued use of the service after the effective date of any update constitutes acceptance of the revised Terms.
